{"id":2030,"date":"2021-09-27T13:26:53","date_gmt":"2021-09-27T11:26:53","guid":{"rendered":"https:\/\/consultingc3blog.com\/?p=2030"},"modified":"2023-06-07T10:16:41","modified_gmt":"2023-06-07T10:16:41","slug":"plan-formacion-renovacion-erte","status":"publish","type":"post","link":"https:\/\/www.consultingc3.com\/blog\/plan-formacion-renovacion-erte\/","title":{"rendered":"Presentar un plan de formaci\u00f3n para renovar los ERTE, requisito indispensable."},"content":{"rendered":"\n<h2 class=\"has-medium-font-size wp-block-heading\">ERTE y Formaci\u00f3n: Estamos contigo<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>La crisis ocasionada por la\u00a0<strong>COVID-19<\/strong>\u00a0ha generado que un gran n\u00famero de empresas se hayan visto abocadas a suspender \u2013total o parcialmente\u2013 los contratos de trabajo de sus trabajadores por concurrir situaciones de fuerza mayor o necesidades, principalmente, productivas, organizativas y econ\u00f3micas (es decir, a tramitar un\u00a0<strong>ERTE<\/strong>). De esta manera, las empresas han intentado ajustar, temporalmente, los recursos humanos de los que dispone a las necesidades del mercado, evitando, o al menos paliando, una destrucci\u00f3n masiva de empleo.<\/p>\n\n\n\n<p>En este contexto en el que la tramitaci\u00f3n de un ERTE bien por fuerza mayor bien por causas objetivas est\u00e1 a la orden del d\u00eda, y dado que ello implica que l<strong>os trabajadores <\/strong>con su contrato laboral suspendido o con jornada reducida,<strong> disponen de mayor tiempo \u201csin ocupaci\u00f3n profesional\u201d<\/strong>, <strong>las empresas se plantean<\/strong> si es posible ofrecer o incluso exigir a sus trabajadores <strong>la realizaci\u00f3n de determinados cursos de formaci\u00f3n durante dicho periodo de tiempo.<\/strong> La respuesta depender\u00e1, en gran medida, del car\u00e1cter voluntario u obligatorio de la formaci\u00f3n en cuesti\u00f3n.<\/p>\n\n\n\n<p>Sin embargo, hacemos<strong> eco de las \u00faltimas noticias:<\/strong><\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\" style=\"line-height:1.4\"><strong><a href=\"https:\/\/www.lavanguardia.com\/economia\/20210921\/7737414\/erte.html\" target=\"_blank\" rel=\"noreferrer noopener\">El Gobierno plantea condicionar las exoneraciones de los ERTE a la formaci\u00f3n (lavanguardia.com)<\/a><\/strong><\/h2>\n\n\n\n<p class=\"has-medium-gray-color has-text-color has-normal-font-size\">Apuesta por prorrogarlos hasta el 31 de enero<\/p>\n\n\n\n<p>El Gobierno plantea prorrogar los ERTE hasta el 31 de enero del 2022, pero condiciona el mantenimiento de las exoneraciones de las empresas a la Seguridad Social a que lleven a cabo <strong>acciones de formaci\u00f3n<\/strong>.<\/p>\n\n\n\n<p>Son dos de los puntos que el Gobierno ha planteado en la mesa de negociaci\u00f3n con los agentes sociales.<\/p>\n\n\n\n<p>En concreto, el plan del Gobierno quiere vincular el mantenimiento de las bonificaciones a la Seguridad Social a la puesta en marcha acciones de formaci\u00f3n a para las personas afectadas por un ERTE. Dicha formaci\u00f3n deber\u00e1 desarrollarse entre el 1 de octubre del 2021 \u00a0y el 30 de junio de 2022.<\/p>\n\n\n\n<h2 class=\"has-medium-font-size wp-block-heading\"><strong>Todas las empresas tendr\u00e1n que solicitarlo antes del 10 de octubre.<\/strong><\/h2>\n\n\n\n<p>As\u00ed se recoge, adem\u00e1s, de manera expresa en el art\u00edculo 5.1 a) del Real Decreto 694\/2017, de 3 de julio, por el que se desarrolla la Ley 30\/2015, de 9 de septiembre, por la que se regula el Sistema de Formaci\u00f3n Profesional para el Empleo en el \u00e1mbito laboral, que subraya que:\u00a0<em>\u201cP<strong>odr\u00e1n ser destinatarios de la formaci\u00f3n profesional <\/strong>para el empleo todos los trabajadores ocupados y desempleados, en los t\u00e9rminos que a continuaci\u00f3n se se\u00f1alan:<\/em>\u00a0<em>De acuerdo con lo establecido en el art\u00edculo 9.1 de la Ley 30\/2015, de 9 de septiembre, en la formaci\u00f3n programada por las empresas, regulada en el cap\u00edtulo II, &#8230; <strong><u>y los trabajadores afectados por medidas temporales de suspensi\u00f3n de contrato por causas econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n, en sus per\u00edodos de suspensi\u00f3n de empleo<\/u>\u201d.\u00a0<\/strong><\/em><\/p>\n\n\n\n<p><strong>Ello implica, adem\u00e1s, que las empresas que est\u00e9n aplicando un ERTE podr\u00e1n acogerse a la formaci\u00f3n bonificada o programada para tal efecto.<\/strong><\/p>\n\n\n\n<p>Por \u00faltimo, no debemos olvidar que el art\u00edculo 16.5 del Real Decreto 1483\/2012, de 29 de octubre, por el que se aprueba el Reglamento de los procedimientos de despido colectivo y de suspensi\u00f3n de contratos y reducci\u00f3n de jornada, relativo al r\u00e9gimen jur\u00eddico aplicable a los ERTEs por causas econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n recoge expresamente que \u201c<strong><em>Durante las suspensiones de contratos de trabajo o las reducciones de jornada se promover\u00e1 el desarrollo de acciones formativas vinculadas a la actividad profesional de los trabajadores afectados cuyo objeto sea aumentar la polivalencia o incrementar su empleabilidad<\/em>\u201d.<\/strong><\/p>\n\n\n\n<p><strong>Por eso desde Consulting C3 queremos mostrar nuestro m\u00e1ximo apoyo ante esta situaci\u00f3n tan complicada en las Empresas.
